Bitcloud Technology Inc. (“Bitcloud,” “we,” “us,” or “our”) respects your privacy and is committed to protecting personal information.

This Privacy Policy describes how we collect, use, disclose, store, and protect information in connection with our websites, applications, products, and services, including BestChat, SmartBot, and other services we may offer from time to time (collectively, the “Services”).

This Privacy Policy applies to information collected or processed through the Services, including information provided directly to us and information made available through authorized integrations with third-party platforms.

Information We Collect

Depending on how the Services are used, we may collect or process the following types of information.

Account and Business Information

Information such as name, business name, business address, website, email address, telephone number, account information, and other information necessary to provide and administer the Services.

Usage and Technical Information

Information such as IP address, browser type, operating system, device information, log information, usage activity, and similar technical information.

Communications and Service Information

Messages, conversations, support requests, and other information processed through or in connection with the Services.

Third-Party Platform and Integration Data

Certain Services allow business customers to connect third-party platforms and services, such as Shopify, Instagram, WhatsApp, and other supported platforms.

When a business customer connects a third-party platform, Bitcloud may access and process information made available through that platform within the permissions authorized by the customer (“Platform Data”).

We process Platform Data only as necessary to provide, operate, support, and secure the Services requested by the applicable business customer and in accordance with applicable platform requirements.

Where we act as a technology provider, Platform Data is processed on behalf of and at the direction of the applicable business customer.

We do not sell Platform Data or use it for unrelated advertising or marketing purposes.

AI-Assisted Features

Certain Services may provide AI-assisted functionality.

Information processed through these features may be processed by Bitcloud and authorized service providers only as necessary to provide and operate the applicable Services.

We do not use data processed on behalf of business customers, personal information, or Platform Data to train or fine-tune any AI or machine learning models, whether our own or those of third parties.

How We Use Information

We may use information collected or processed through the Services to:

• provide, operate, maintain, secure, support, and improve the Services;
• provide features and functionality requested or authorized by business customers, including AI-assisted and human-assisted services;
• administer customer accounts and authorized third-party integrations;
• communicate with customers and provide support;
• monitor and protect the security, integrity, and appropriate use of the Services; and
• comply with applicable laws, regulations, platform requirements, and contractual obligations.

We do not use personal information or Platform Data for purposes materially unrelated to the Services for which the information was collected or provided.

Business Customers and Their End Users

Businesses using our Services may provide or make available information relating to their customers, visitors, or other individuals.

Where applicable, the business customer determines the purposes for which such information is processed, and Bitcloud processes that information on behalf of the business customer and in accordance with its instructions, the applicable Services, our agreements, and applicable law.

Business customers are responsible for ensuring that they have the necessary rights, notices, permissions, and lawful basis to provide information to us and to use the Services.

If an individual submits a privacy request relating to information that we process on behalf of a business customer, we may refer the request to that business customer or assist the business customer in responding as appropriate.

How We Share Information

We do not sell personal information.

We may disclose information to service providers and subprocessors that help us provide, operate, secure, and support the Services.

Such providers may process information only as necessary to perform services for us and are subject to applicable contractual, confidentiality, privacy, and security requirements.

We may also disclose information where required by applicable law or legal process, where reasonably necessary to protect our rights or security or those of our customers or users, or in connection with a merger, acquisition, corporate reorganization, sale of assets, or similar business transaction.

We do not provide personal information or Platform Data to third parties for their independent marketing purposes.

Data Retention

We retain information only for as long as reasonably necessary to provide the Services, fulfill the purposes described in this Privacy Policy, comply with applicable contractual and platform requirements, maintain security, resolve disputes, and satisfy applicable legal obligations.

Retention periods may vary depending on the type of information, the Services used, customer configuration, platform requirements, contractual requirements, and applicable law.

Where information is no longer required, we delete, anonymize, or otherwise securely dispose of it in accordance with applicable requirements.

We delete Platform Data in accordance with applicable platform terms, policies, and legal requirements, including where access has been revoked, the applicable integration has been disconnected, the data is no longer necessary for the authorized purpose, or a valid deletion request has been received.

Data Access, Correction, and Deletion

Users and business customers may request access to, correction of, or deletion of applicable personal information processed by Bitcloud, subject to applicable law.

To submit a privacy or data deletion request, please email privacy@bestchat.com.

Please provide sufficient information for us to identify the relevant account, business, integration, or data associated with your request. We may request additional information where reasonably necessary to verify your identity or authority to make the request.

Upon verification of a valid deletion request, we will delete applicable Platform Data without undue delay, except where retention is required by applicable law.

Other applicable personal information will be deleted or anonymized as appropriate, subject to applicable legal requirements.

Cookies and Similar Technologies

We may use cookies and similar technologies to operate, secure, and improve our websites and Services and to maintain user sessions and preferences.

Where required by applicable law, we will obtain appropriate consent for non-essential cookies or similar technologies.

Data Security

We maintain reasonable administrative, technical, and organizational safeguards designed to protect information against unauthorized access, loss, misuse, alteration, or disclosure.

Access to personal information and Platform Data is limited to personnel and service providers who require access for legitimate business purposes and who are subject to appropriate confidentiality and security obligations.

However, no method of transmission over the Internet or electronic storage is completely secure, and we cannot guarantee absolute security.

International Data Processing

Bitcloud is based in Canada, and information may be processed by Bitcloud or our service providers in Canada, the United States, or other jurisdictions.

Where required, we use appropriate contractual, organizational, and technical safeguards for information processed by third-party service providers.

Information processed in another jurisdiction may be subject to the laws of that jurisdiction and may be accessible to courts, law enforcement agencies, or governmental authorities where permitted by applicable law.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes to our Services, information practices, technologies, legal or platform requirements, or other operational needs.

When we make material changes, we will update the “Last Updated” date and, where appropriate, provide additional notice.
